These Terms and Conditions set out the basis on which Mutiara provides inheritance law services to clients in Malaysia. By engaging our services or submitting an enquiry through our website at mutiara.biz, you acknowledge that you have read and understood these terms. We encourage you to read them carefully and contact us if you have any questions before proceeding.

Mutiara is a legal practice based at No. 33, Jalan Telawi 5, Bangsar Baru, 59100 Kuala Lumpur. Our services are subject to applicable Malaysian law, including the Legal Profession Act 1976 and its subsidiary regulations.

1. Scope of Services

The precise scope of services for each engagement is confirmed in a separate letter of engagement, which forms part of our agreement with you. These Terms and Conditions apply alongside and are incorporated into that engagement letter.

Information provided through our website, including any general content about Malaysian inheritance law, is for general orientation only and does not constitute legal advice. A formal professional relationship commences only upon execution of a signed engagement letter.

2. Fees and Payment

Our service fees are as set out in our current fee schedule and confirmed in your engagement letter. Indicative fees for our three service tiers are:

Fees are quoted in Malaysian Ringgit (RM) and are exclusive of applicable taxes, government fees, court filing fees, third-party disbursements, and out-of-pocket expenses, which are billed separately as incurred. All fees are payable as specified in the engagement letter, typically upon commencement of the service or at agreed milestones.

We reserve the right to pause work on an engagement where a payment is significantly overdue and has not been resolved following notice to you. We will always communicate clearly before taking any such step.

We are not liable for delays, errors, or adverse outcomes arising from incomplete or inaccurate information provided by you, or from failure to respond to requests within a reasonable period.

4. Confidentiality

All information you share with us in the course of an engagement is treated as confidential. We will not disclose your personal or case information to any third party without your consent, except where required by law, court order, or applicable professional obligations.

Our staff and associates are bound by professional duties of confidentiality and by the terms of our internal data protection policies. Please refer to our Privacy Policy for full details of how personal data is collected, used, and safeguarded.

5. Professional Standards and Limitations

Mutiara's services are carried out by qualified legal professionals subject to the standards and disciplinary framework of the Bar Council Malaysia. We will at all times act in your best interests, maintain independence, and avoid conflicts of interest.

Our advice is based on Malaysian law as it stands at the time it is given. We do not accept responsibility for changes in law or court practice that occur after advice has been provided, unless you have engaged us on an ongoing basis that encompasses such updates.

Where a matter falls outside our area of practice, we will let you know clearly and, where appropriate, suggest that you seek specialist advice elsewhere.

6. Website Content and Intellectual Property

All content on this website — including text, layout, and design — is the property of Mutiara and is protected under Malaysian copyright law. You may view and print content for your personal, non-commercial use. You may not reproduce, republish, or distribute any part of this website without our written permission.

Documents prepared specifically for your engagement remain the property of Mutiara until full payment has been received, at which point originals are made available to you as agreed.

7. Termination of Engagement

Either party may end an engagement by giving reasonable written notice. If you choose to end the engagement, you remain responsible for fees for work carried out up to the date of termination, together with any disbursements already incurred.

In certain circumstances, we may need to cease acting for you — for example, where a conflict of interest arises that cannot be managed, or where instructions are received that we are professionally unable to follow. In such cases, we will give you as much notice as the circumstances allow and assist you in transitioning the matter to another practitioner where feasible.

8. Limitation of Liability

Our liability to you in connection with any engagement is limited to direct losses arising from our own negligence or misconduct. We are not liable for indirect, consequential, or unforeseeable losses, including financial loss arising from decisions you make on the basis of general information on our website rather than formal legal advice obtained through an engagement.

Nothing in these Terms and Conditions limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited under Malaysian law.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with these terms, including questions of interpretation, shall be subject to the exclusive jurisdiction of the Malaysian courts, with Kuala Lumpur as the agreed seat.

Where a dispute cannot be resolved amicably, we encourage mediation through the Malaysian Mediation Centre as a first step, where appropriate.

10. Changes to These Terms

We may revise these Terms and Conditions from time to time to reflect changes in our services or applicable law. The updated date shown at the top of this page will reflect any revisions. The terms in force at the time of your engagement are those that apply to that engagement.
