Who We Are

The Mutiara Story

Mutiara was established in Kuala Lumpur in 2008 by a small group of legal practitioners who noticed a gap — families navigating estate and inheritance matters were often left feeling confused, rushed, or underserved. The firm was founded to change that.

The name Mutiara — meaning pearl in Malay — reflects the practice's philosophy: that a well-considered estate plan is something of lasting value, shaped gradually, with care. Just as a pearl forms slowly within its shell, so too should decisions about legacy be made with patience and intention.

Today, the firm serves families across Kuala Lumpur and the Klang Valley, handling matters from straightforward will preparation to complex multi-generational estate administration. Our team is experienced in both civil and Islamic inheritance frameworks, and we take particular care to communicate clearly at every stage.

Inheritance Law in Malaysia — What Families Should Know

Estate planning in Malaysia operates across two distinct legal frameworks: civil law, which applies to non-Muslims, and Islamic law (including faraid principles), which governs the distribution of a Muslim's estate. Both frameworks have their own procedural requirements, timelines, and implications for beneficiaries — and navigating them without legal guidance can lead to delays, disputes, or unintended outcomes.

For Muslim Malaysians, a wasiat (will) offers a structured way to express wishes, though faraid rules govern the distribution of the undistributed portion of an estate. A hibah — a gift made during one's lifetime — may also be considered as part of a broader legacy plan. Understanding how these instruments interact is important, particularly for those with varied asset types or complex family structures.

For non-Muslim Malaysians, a civil will prepared under the Wills Act 1959 provides clarity and helps prevent the delays associated with intestate succession. Where no will exists, the Distribution Act 1958 determines how assets are allocated — which may not align with the deceased's wishes.

Estate administration — the process of managing a deceased person's estate following death — typically involves obtaining either a Grant of Probate (where a valid will exists) or Letters of Administration (where none does). These proceedings are handled through the Malaysian High Court, and can take several months depending on the complexity of the estate and any complications that arise.
